Agenda Item #38: Select Dana Point Harbor Partners LLC as primary and Dana Point Partners LLC as alternate for lease, development and management of certain portions of Dana Point Harbor; authorize negotiation of agreements for Board approval; and make California Environmental Quality Act and other findings - District 5.

On March 3, 2016, Your Dana Point Boaters Association Recommendation for P3 Owners’ Representative.  One of the features of the arrangement in pursuit of a Private-Public-Partnership (P3) by The County of Orange is the provision for hiring an owners’ agent to represent their interests (as well as the citizens of the State of California) full time during the engagement of the P3 master leaseholder and developer, from planning and contract negotiations forward. You can read our letter here!

During the last 24 hours your Dana Point Boaters Association has been working almost nonstop to obtain the Dana Point City Council Agenda Item #18 Documents to post to our website.  Unfortunately, the notification came out yesterday but, the actual agenda document are mostly unreadable.  Today we've been working all day to track down the original documents and complying them together into a readable format on our own.  We've been in email & phone correspondence with OC Dana Point Harbor & City of Dana Point.  The City this morning was able to provide use with a CD in the original Word .doc formate and also .PDF files which we have now complied herein.  The following document originally contained 520 pages, you will note, pages 55 threw 165 are NOT numbered because these pages were removed and reinserted by us from the original document file provided to the City.  Please remember some files are very large and may take a bit to download depending on your internet service provider. We have complied this document into the following 6 break sections: November 18th Agenda (Please DO NOT use the agenda link for document, it's mostly unreadable for over 200 pages) Item #18 Section #1, Section #2, Section #3, Section #4, Section #5 and Section #6.

Your Dana Point Boaters Association has directed a Cover Letter to the addressed parties for consideration before, during and after the upcoming local appeal rehearing of Dana Point Harbor Landside Reconstruction CDP (Coastal Development Permit) # 13-0018(I) planned for November 18th, 2014. Attached to the Cover Letter was a nine page, Detailed Analysis of Recreational Boating Construction Issues and Mitigations which we strongly believe should be stipulated, as requirements for the approval of the subject Dana Point Harbor Revitalization CDP by City of Dana Point City Council.

The City of Dana Point has responded to our Public Recorders Request (CDP Appeal Hearing Documents) with the following documents that are now finalized from OC DPH, County of Orange.  We are still awaiting the receipt of the other CDP appeal documents that will be a part of the appeal hearing scheduled for (at this time) Tuesday, November 18, 2014.  The following, are only two parts, of the significate issues, that were appealed by California Coastal Commission.  The first document is the revised "Wave Uprush Analysis" and the second document is the revised "Dana Point Harbor Shoreline Management Plan".  Both these document are very large so please be patient when downloading!

he following is the formal response from OC Dana Point Harbor to our Public Records Request, which only included one section 6.2.5 per our requests "OC Dana Point Harbor Response".  As of this writing we have yet to receive any further information from our request.  We do find it "strange", that the OC Dana Point Harbor has refused our public information request but we got their (OC DPH) documents from the City of Dana Point who complied with our request.

(July 8, 2014) Please be advised that the Coastal Development Permit (CDP) decision for the Dana Point Harbor Commercial Core Revitalization has been appealed to the California Coastal Commission pursuant to Public Resources Code Section 30602 or 30625.  Therefore, the decision has been stayed pending Commission action on the appeal pursuant to Public Resources Code Section 30623.  The tentative appeal hearing date is scheduled during the CCC Hearing in August 2014 in San Diego.  To read the California Coastal Commission Appeal, (Commissioners Mary K Shallenberger & Dr. Robert Garcia) please click on the the following link: A-5-DPT-14-0036.

Your Dana Point Boaters Association has acquired and released the following "Finalized" documents in response to Orange County Dana Point Harbor (CDP) Coastal Development Permit, Dana Point Harbor Landside Improvement Project. The following "Finalized" CDP Application and supporting documents were submitted to the City of Dana Point last month.  The following "Finalized" Application and Supporting Documents have been provided to DPBA per our request for the CDP Application documents.
